The flagbearer of the United Front Party has written to the Electoral Commission protesting his disqualification from the upcoming elections and demanding to be reinstated.
Dr Nana Agyenim Boateng, conceded that there were mistakes with the forms he submitted to the EC but said those mistakes were acts of omissions and commissions by his subscribers which cannot be grounds for disqualification.
At worse, he said the Commission was mandated to draw his attention to the mistakes so he can correct them and not to disqualify him.
Dr Agyenim Boateng was amongst 12 other presidential candidates disqualified by the Electoral Commission from contesting the upcoming elections.
EC Chair Charlotte Osei said the candidates were disqualified for various acts of fraud, negligence, voter irregularities etc.
But in a letter dated October 12, 2016, the flagbearer, through his lawyer Franklin Kwabena Asamoah said even though he breached Regulations 7(4) of CI 94 the same regulation demanded that he be given an opportunity to correct the anomaly.
“It is our humble submission that these acts are not directly attributable to our client. Rather they are acts of subscribers whose sins must not be visited on our client for the simple reason that;
(1) Our client had no way of controlling the conduct and or behavior of a subscriber.
(2) Our client had no way of knowing that his subscribers had subscribed for some other person.
“In a situation of this nature, it is equitable, fair and just to invite our client and give him time to rectify such infractions that do not directly flow from the person of our client,” the letter said.
The UFP is therefore hoping the EC will rescind its decision and reinstate Dr Agyenim Boateng to contest in the elections.
The letter fell short of stating whether the UFP will be going to court to enforce the rights of the candidate in the event the EC fails to reinstate him.
