Flag bearer of the All People’s Congress (APC) Hassan Ayariga has welcomed the decision by the High Court ordering the Electoral Commission to allow the Presidential Candidate of the Progressive People’s Party (PPP) to correct the mistake on his nomination papers.
“This shows our laws are working. Congratulations to the PPP and a lot of appreciation to the court for their judgment. We want to promote a multi-party democratic state. EC ought to seek legal advice from their lawyers before passing any judgment. EC must learn to act properly. They have to be careful about serious parties like APC and PPP” he stated.
The Court quashed the Commission’s decision to disqualify Dr Papa Kwesi Nduom from contesting this year’s election, citing errors on his nomination papers.
The Court, presided by Justice Eric Kyei Baffour dismissed as pedestrian, arguments by the EC that the Court had no power to order the Commission to perform a certain action because it is an independent institution set up by the Constitution.
He ordered the EC to allow Dr. Nduom to amend his nomination papers and submit them in accordance with regulation 9 of CI 94 which govern this year’s election.
However reacting to the development, Mr. Ayariga opined that the judgment of the court questions the credibility of the Electoral Commission, especially the purported disqualification of thirteen presidential aspirants.
“The implications of making wrong decisions affect their credibility. They (EC) ought to seek legal advice from their lawyers before their disqualifications. We (APC) didn’t deserve to be disqualified from the race. Political parties don’t have access to the systems to check on subscribers to know if they had already registered with another political party” the APC flag bearer said on Accra based Class fm.
He continued “The (PPP and APC) had over 3000 delegates to endorse their flag bearers, why does EC think they can’t afford 432 subscribers to endorse their presidential nomination forms?”
