Mr. Kingsley Amoakwah father of two teenage boys has petitioned the Chief Justice Mrs Theodora Georgina Wood to investigate a case he filed at the Winneba Magistrate Court in September 2008 which has been struck out without his notice.
The case was to have custody of his two boys, Master Emmanuel Kingsley Enyan, 19 and Lord Kingsley Enyan 16, who are children from his former wife Rita Acquah a native of Gomoa Nsuaem near Gomoa Awomberewo on the Winneba-Swedru Road.
Mr. Amoakwah said this in an interview with thee Ghana News Agency at Winneba.
He said since the case with reference number A2/166/2008 started about 10 years ago trial has never commenced for justice to prevail.
He said that as a result, he petitioned the Chief Justice in June 2009 to complain about one of the panel members of the family tribunal handling the case Mr. G. K. Acquah who he alleged to have some interest in the case.
Mr Amoakwah said following the petition to the Chief Justice in a letter dated 8th January 2010, the Winneba Magistrate Court was directed to re-empanel the tribunal for the purpose of continuing with the trial.
He said in spite of the Chief Justices directives, the court refused to continue with the case.
He alleged that anytime he reports at the court to find out the date on which the proceedings would re-opened, he is informed by the Registrar of the court that, the Chief Justices has come for the docket to study the case.
He said, he became surprised when he received a letter dated 21st December 2016 from the court indicating that the case has been stuck out for want of prosecution, since July, 24th 2013.
“I am not satisfied with the content in the reply to my petition dated 9th December 2016 hence am appealing to the Chief Justice to conduct a special investigation into the action taken by the court to ensure justices and fair play, because I need my children”, Mr. Amoakwah said.
