The Electoral Commission (EC) has responded to Dr Papa Kwesi Nduom of the Progressive People’s Party’s (PPP), application for a judicial review on his disqualification as a presidential candidate.
In an affidavit in opposition, the EC prayed the High Court to dismiss Dr Nduom’s application.
According to the EC, the PPP Flag bearer’s call on the High Court to quash the EC’s decision to disqualify him from contesting in the December 7, 2016 presidential election was incompetent and must, therefore, not be granted.
Dr Nduom, who was disqualified to contest on October 14, 2016, filed the application through his lawyer four days after his disqualification.
He wants the court to restrain the EC from proceeding with balloting for position of presidential candidates for the 2016 elections until the final determination of the suit.
But the EC in an affidavit in opposition sworn on its behalf by its chairperson, Mrs Charlotte Osei is asking the court, “the applicant’s instant motion is woefully incompetent and does not properly invoke the jurisdiction of the Court for the reliefs sought and that being an originating process, our lawyers shall in the course of responding to the application at its hearing, pray the Court to dismiss the application.”
