Lawyer of Fadi Samih Daboussi maintains that his clients still stands by the contents of two alleged libelous articles that resulted in his arrest by operatives of the Bureau of National Investigations (BNI).
Hassan Tampoli on the Ultimate Breakfast Show hosted by Lantam Papanko, stated that the articles published on some portals, are pointers of existing issues already in the public domain and still stands by them unless proven otherwise.
“Of course he still stands by those articles unless there is a contrary prove. The pointers of the articles are already in the public domain. I am yet to meet Fadi Dabbousie after his release on Sunday night and will accordingly advise him” he revealed.
He is however not enthused that the BNI is dabbling in a case it has no jurisdiction over describing it as a threat to the country’s democracy.
“If anyone feels scandalized by the publications of Fadi Daboussie, the law provides for the person to either write a rejoinder which will be given the same prominence or go to the courts and press charges of defamation or for character assassination”, he disclosed.
Hassan Tampoli said it is outlawed to use the state apparatus to intimidate his client which is not even the right channel to deal with such matters.
Private legal practitioner Kwame Adofo who concurred with the stance of Fadi’s counsel, indicated that the BNI abused provisions of the 1992 constitution.
“You don’t go arresting people, simply because you don’t like what they write. You don’t detain people without telling them what they have done. It is not proper for law officers to act in a way that violates people’s right”, he intimated.
It has finally emerged that the Ghanaian writer and pilot Fadi Samih was not detained because of the book authored titled: “59 Years to nowhere but for allegedly writing articles making offensive comments about President John Mahama on some websites.
