An Accra HIGH Court presided over by His Lordship, Justice Kweku T. Ackaah-Boafo, has stopped the swearing-in of Mr. George Tackie Abia, who is known as Adama Latse, a claimant to the Ga Mantse stool.
The judgment, which was delivered on Monday, February 13, 2017, declared the ruling by an Accra High Court presided over by Her Lordship Justice Mrs. Justice Gifty Dekyem delivered in January 2017 as null and void.
The case, which was ruled in favour of the plaintiffs-Ga Paramount Stool Kingmaker, Dr. Nii Tetteh Kwei II, and Nii Agyeman Kese II, the surviving Head of Nii Tackie Komey Royal Ruling House versus the Ga Traditional Council and Nii Dodoo Nsaki III as defendants, was brought to the High Court in Accra on January 31, 2017.
A writ filed for an Interlocutory Injunction, moved on January 13, 2017 by the plaintiffs—Nii Tetteh Kwei II and Nii Agyeman Kese II—restrained the Ga Traditional Council from inducting Adama Latse until the final determination of the suit pending in court.
In their Statement of Claim filed in the writ, the plaintiffs said the first defendant, George Tackie Abia, held himself as the Ga Mantse.
However, the plaintiffs stated that they were the legitimate kingmakers of the Ga Paramount Stool and have the capacity to nominate, select and install the Ga Mantse.
At a press conference organised by the Principal Kingmaker, Dr. Nii Tetteh Kwei II, and elders of the Ga Royal Paramount Stool, who took time to explain the content of the said ruling, they indicated that the motion filed against the ruling that Adama Latse’s name be sworn-in as the Ga Mantse was null and void.
However, the said ruling as delivered by Justice Kweku T. Ackaah-Boafo stated clearly that… “Having regarded the pleading filed in this case and ably submitted by Counsel for the plaintiffs and given the special circumstance and facts of the case and on the balance of convenience, I hold that the plaintiffs/applicants cannot be denied the temporary relief sought.”
