The nation’s election management body says it has filed for review at the Supreme Court over the decision.
High Court judge Justice Kyei Baffour last Friday ruled that the EC should give Dr Nduom the opportunity to make corrections to his nomination forms and re-file.
But in a statement released on Monday, October 31, the Commission says: “Having carefully studied the contents of the judgement, we respectfully disagree with the High Court judge’s decision on several essential legal and public policy grounds”.
It explained that candidates seeking the highest office of the land must take full responsibility in ensuring that their forms meet the required standards of law.
“The Commission believes that as in other jurisdictions presidential candidates must ensure the accuracy of the information on documents which they present under oath to public institutions,” the statement signed by Eric Kofi Dzakpasu, the Head of Communications at the Commission, said.
“Failure to place this burden on the shoulders of the candidates has serious implications for our democratic growth and electoral justice”.
The Commission says its pursuance for clarification at the Supreme Court is in “the overall national interest” an “on the grounds of public policy”.
The Commission appealed to the Chief Justice to ensure expeditious determination of its review application in order not to tamper with the electoral calendar.
