The Supreme Court has declared as unconstitutional, former President Mahama’s decision to host two former Guantanamo Bay detainees in Ghana.
This follows a suit that was filed by two Ghanaians who asked the Supreme Court to interpret the constitutionality or otherwise of the decision of the President.
The Supreme Court has therefore ordered government to go back to parliament to ratify the agreement between the two countries within three months or have the two men – Mahmud Umar Muhammad Bin Atef, and Khalid Muhammad Salih Al-Dhuby sent back to the United States of America.
The reading out the judgement, Chief Justice Sophia Akufo stated categorically that Former President Mahama’s government should have sort parliamentary approval in agreeing to some international agreement including that of the GITMO two hence the order for the agreement to be sent to parliament.
