The International Court of Arbitration of the International Chamber of Commerce (ICC) has dismissed a petition by Ghanaian businessman Alfred Agbesi Woyome over the controversial GHC51.2 million debt owed the State.
A cost of 5,000 dollars has been awarded against Mr Woyome who was seeking to defend the judgement paid to him by the State.
The action he initiated at the ICC in March this year followed a last year’s Supreme Court judgement that he received the money through fraudulent means as there was no contract between him and the state, hence ordered to refund.
Until Mr Woyome initiated the action at the ICC, he had refunded to the State a total of GH¢4 million out of the total sum.
The court on August 3, dismissed the case at the preliminary stage on grounds of lack it lacked jurisdiction as per Article 6(4) of the court.
It states: “The arbitration shall proceed if and to the extent that the Court is prima facie satisfied that an arbitration agreement under the Rules may exist.”
That is there can be no arbitration without an arbitration agreement between the parties.
The court in dismissing the application on Thursday, said the action by Mr Woyome failed to satisfy that rule.
